Kausfiles has a very good bit about the recent pornography decision. I had a similar thought - that Thomas distinguished himself in this particular opinion - but not spun quite the way Kausfiles does. I'm impressed that, in spite of the fact that his name will always be associated with porn in the public mind, Thomas was nonetheless willing to concur with the majority to strike down an anti-porn law, on reasoned and principled grounds. I'm just impressed at his courage, that he wouldn't simply sign someone else's opinion. And I'm impressed with the opinion as well. |
